हिंदी भाषी उपयोगकर्ताओं के लिए हिंदी में एक सूचनात्मक अनुवाद। यह संस्करण केवल आपकी सुविधा और समझ के लिए प्रस्तुत किया गया है; कानूनी रूप से बाध्यकारी और प्रामाणिक संस्करण जर्मन में उपलब्ध शर्तें हैं, जो https://lingoshu.com/terms पर देखी जा सकती हैं। भाषा का यह चयन उस अनिवार्य उपभोक्ता-संरक्षण को आपसे नहीं छीनता जो आपको आपके निवास-देश के कानून के अंतर्गत प्राप्त है (देखें अनुभाग 14, रोम-I-विनियमन का अनुच्छेद 6 खंड 2)।

ये शर्तें „LingoShu Translator“ ऐप और lingoshu.com वेबसाइट पर लागू होती हैं।

1. क्षेत्र, सेवा-प्रदाता और अनुबंध-पक्ष / Scope, Provider, Contracting Party

ये उपयोग की शर्तें (आगे „उपयोग की शर्तें“) iOS-ऐप „LingoShu Translator“ (आगे „ऐप“) और वेबसाइट lingoshu.com (आगे दोनों मिलाकर „सेवा“) के उपयोग पर लागू होती हैं। ये एक उपयोगकर्ता के रूप में आपके (आगे „आप“) और सेवा-प्रदाता के बीच के संबंध को नियंत्रित करती हैं, और साथ ही ऐप के लिए अंतिम-उपयोगकर्ता लाइसेंस-शर्तें (अनुभाग 4 और 15) भी समाहित करती हैं।

हम अपनी सेवा विशेष रूप से जर्मन नागरिक संहिता (BGB) की धारा 13 के अर्थ में उपभोक्ताओं को प्रदान करते हैं। ये उपयोग की शर्तें केवल आपके और हमारे बीच संपन्न होती हैं, Apple के साथ नहीं। Apple केवल वह App Store उपलब्ध कराता है जिसके माध्यम से आपने ऐप प्राप्त की है; Apple की भूमिका का विवरण अनुभाग 6, 7 और 15 में दिया गया है। ऐप वर्तमान में विशेष रूप से Apple App Store के माध्यम से ही वितरित की जाती है।

ये उपयोग की शर्तें, गोपनीयता नीति (lingoshu.com/privacy) और विधिक सूचना/Impressum (lingoshu.com/impressum) मिलकर सेवा के उपयोग का कानूनी आधार बनाती हैं। गोपनीयता नीति बताती है कि हम किन डेटा का प्रसंस्करण करते हैं; डेटा-प्रसंस्करण से जुड़े प्रश्नों में किसी विरोधाभास की स्थिति में गोपनीयता नीति को प्राथमिकता मिलती है। आप इन उपयोग की शर्तों को किसी भी समय lingoshu.com/terms पर देख, सहेज और प्रिंट कर सकते हैं। खाता बनाकर अथवा सेवा का उपयोग करके आप इन उपयोग की शर्तों को स्वीकार करते हैं।

These Terms govern your use of the LingoShu Translator app and the lingoshu.com website and also contain the end-user licence terms for the app (Sections 4 and 15). The provider and your contracting party for use of the service is VinLihs Digital Services, owner Vincent Leinhos, Mainzer Landstr. 148, 60327 Frankfurt am Main, Germany ([email protected]). The service is offered to consumers only. These Terms are concluded between you and us, not with Apple — Apple only operates the App Store through which you obtained the app (the app is currently distributed exclusively via the Apple App Store). Together with our Privacy Policy and Legal Notice (Impressum), these Terms form the legal basis of your use; for data-processing questions the Privacy Policy prevails. You can view, save and print these Terms at lingoshu.com/terms. By creating an account or using the service you accept these Terms.

2. अनुबंध-विषय और सेवा-विवरण / Subject Matter and Description of Service

LingoShu Translator दो व्यक्तियों के बीच आमने-सामने की व्यक्तिगत बातचीत के लिए एक AI-आधारित भाषण-अनुवाद ऐप है। दो वार्ताकार अपनी-अपनी भाषाएँ चुनते हैं, रिकॉर्ड करते हैं और बोलते हैं; ऐप कही गई बात को लिपिबद्ध (ट्रांसक्राइब) करती है और उसका अनुवाद करती है। सेवा अनेक भाषाओं का समर्थन करती है; उनकी वर्तमान सूची आपको ऐप में मिलेगी।

ऐप दो संचालन-विधियाँ (मोड) प्रदान करती है:

गुणधर्म (क्वालिटी) संबंधी महत्वपूर्ण सूचना: अनुवाद और ट्रांसक्रिप्शन कृत्रिम बुद्धिमत्ता (AI) की सहायता से मशीनी रूप से उत्पन्न किए जाते हैं। जैसा कि हर स्वचालित अनुवाद में होता है, इनमें अशुद्धियाँ, त्रुटियाँ अथवा संदर्भ के अनुकूल न होने वाले शब्द-प्रयोग हो सकते हैं। सेवा रोज़मर्रा की व्यक्तिगत बातचीत में सहायता हेतु बनाई गई है। यह चिकित्सीय, कानूनी, सरकारी/प्रशासनिक, वित्तीय अथवा अन्य सुरक्षा-संवेदनशील स्थितियों तथा आपात स्थितियों में, जहाँ त्रुटियाँ क्षति पहुँचा सकती हैं, विश्वसनीय अनुवाद के रूप में उपयोग के लिए न तो अभिप्रेत है और न ही उपयुक्त है। ऐसी स्थितियों में कृपया किसी योग्य विशेषज्ञ अथवा मानव अनुवादक की सहायता लें। अनुवादों का यह मशीनी, AI-आधारित सृजन सेवा का एक सहमत-गुणधर्म (vereinbarte Beschaffenheit) है (देखें अनुभाग 9); आपके वैधानिक दोष-अधिकार (Mängelrechte) इससे अप्रभावित रहते हैं।

सेवा केवल कुछ निश्चित देशों में ही प्रदान की जाती है। अस्वीकृत क्षेत्रों से आने वाले अनुरोध अस्वीकार कर दिए जाते हैं (क्षेत्रीय उपलब्धता, देखें अनुभाग 8 और गोपनीयता नीति)।

LingoShu provides AI-assisted speech translation for one-to-one conversations in a range of languages (see the current list in the App), in two modes: an Online mode (audio is sent via our backend to OpenAI's APIs for speech recognition and translation; it needs connectivity and third-party availability, and audio/transcripts are processed in memory only, not stored on our servers) and an Offline mode (fully on-device via Apple's frameworks; nothing leaves your device, subject to device support for the language pair). Translations are machine-generated by AI and may be inaccurate or incomplete. The service is for everyday conversation and must not be relied upon in medical, legal, official, financial or safety-critical situations or emergencies where errors could cause harm — use a qualified professional there. This AI-based generation is an agreed quality of the service (see Section 9); your statutory warranty rights remain unaffected. The service is offered in selected countries only.

3. अनुबंध का संपन्न होना, खाता और पात्रता-शर्तें / Contract Formation, Account, Eligibility

सेवा का उपयोग करने के लिए आप „Sign in with Apple“ के साथ साइन-इन करते हैं। इसमें हमें Apple से केवल एक अपारदर्शी (opaque) उपयोगकर्ता-पहचानकर्ता प्राप्त होता है; हमें न तो आपका नाम और न ही आपका ई-मेल पता मिलता है (विवरण गोपनीयता नीति में)। पहली बार साइन-इन और खाता बनाने के साथ ही आपके और हमारे बीच सेवा के उपयोग का अनुबंध संपन्न हो जाता है।

सेवा का उपयोग 13 वर्ष व अधिक आयु के व्यक्तियों को अनुमत है। यदि आपके निवास-देश का कानून सेवा के उपयोग के लिए अथवा वैध सहमति के लिए इससे अधिक की न्यूनतम आयु निर्धारित करता है, तो वही लागू होगी। 13 से 18 वर्ष के अवयस्क (नाबालिग) सशुल्क सुविधाएँ (विशेष रूप से Pro-सदस्यता और क्रेडिट/मिनट पैकेज) केवल किसी कानूनी अभिभावक की सहमति से अथवा उन्हें स्वतंत्र उपयोग हेतु दिए गए साधनों के दायरे में ही (BGB की धारा 110) खरीद सकते हैं। कोई सशुल्क खरीद करके आप पुष्टि करते हैं कि ये शर्तें पूरी होती हैं।

प्रति उपयोगकर्ता एक खाता निर्धारित है। अपने Apple-खाते तक और इस प्रकार अपने LingoShu-खाते तक पहुँच की समुचित सुरक्षा के लिए आप स्वयं उत्तरदायी हैं।

You sign in with Apple; we receive only an opaque identifier, not your name or email. The use contract is formed when you first create an account. The minimum age to use the service is 13; where the law of your country of residence sets a higher minimum age, that higher age applies. Minors aged 13–18 may buy paid features (Pro subscription, credit packs) only with the consent of a legal guardian or within means left to their free disposal (Sect. 110 BGB); by making a paid purchase you confirm this. One account per user; you are responsible for protecting access to your Apple account.

4. उपयोग-अधिकार / Licence

हम आपको ऐप का उपयोग बातचीत के व्यक्तिगत, गैर-वाणिज्यिक अनुवाद हेतु करने का एक साधारण (गैर-अनन्य), अहस्तांतरणीय तथा अनुबंध-अवधि तक सीमित अधिकार प्रदान करते हैं। यह लाइसेंस आपके स्वामित्व अथवा नियंत्रण वाले सभी Apple-डिवाइसों पर, विशेष रूप से Apple Media Services शर्तों के उपयोग-नियमों के अनुरूप, उपयोग हेतु मान्य है। ऐसे डिवाइसों पर उपयोग, जिनके आप न तो स्वामी हैं और न ही जिन पर आपका नियंत्रण है, तथा अनेक डिवाइसों द्वारा एक-साथ उपयोग के लिए नेटवर्क के माध्यम से वितरण अनुमत नहीं है; साझा उपयोग उस सीमा तक अनुमत है जिस सीमा तक उपयोग-नियम (विशेष रूप से Family Sharing/पारिवारिक साझाकरण) इसकी अनुमति देते हैं।

इस लाइसेंस की समाप्ति अनुभाग 11 के अनुसार (विशेष रूप से गंभीर उल्लंघनों पर) तथा वैधानिक प्रावधानों के अनुसार होती है; हम लाइसेंस को मनमाने ढंग से रद्द करने का कोई स्वतंत्र अधिकार सुरक्षित नहीं रखते।

ऐप से जुड़े समस्त अधिकार, जिनमें सभी कॉपीराइट, ट्रेडमार्क तथा अन्य संरक्षण-अधिकार शामिल हैं, हमारे अथवा हमारे लाइसेंसदाताओं के पास ही रहते हैं। ऑफ़लाइन मोड में उपयोग किए जाने वाले भाषा- और अनुवाद-मॉडल Apple के हैं और उनकी शर्तों के अधीन हैं। इन उपयोग की शर्तों में स्पष्ट रूप से प्रदान किए गए अधिकारों के अतिरिक्त, ऐप से जुड़े कोई भी अधिकार आपको हस्तांतरित नहीं किए जाते।

We grant you a limited, non-exclusive, non-transferable licence, limited to the term of the contract, to use the app for personal, non-commercial conversation translation on any Apple device you own or control, consistent with the Usage Rules of Apple's Media Services Terms (no use on devices you do not own/control; no network distribution for simultaneous multi-device use; shared use is permitted as the Usage Rules permit, including Apple Family Sharing). Any termination of this licence follows Section 11 (in particular for serious breach) and statutory law; we do not reserve a free right to revoke the licence at will. All intellectual property in the app remains with us or our licensors; the offline language models belong to Apple and are subject to Apple's terms. No rights beyond those expressly granted are transferred.

5. उपयोगकर्ता के कर्तव्य और आचरण-नियम / User Obligations and Acceptable Use

आप सेवा का उपयोग केवल लागू कानून और इन उपयोग की शर्तों के अनुरूप ही कर सकते हैं। जिन सामग्रियों का आप अनुवाद करवाते हैं, तथा जिस प्रकार से आप अनुवादों का उपयोग करते हैं, उसके लिए केवल आप ही उत्तरदायी हैं।

विशेष रूप से, निम्नलिखित अनुमत नहीं है:

इन कर्तव्यों के उल्लंघन से अनुभाग 11 के अंतर्गत कार्रवाई हो सकती है।

Use the service only lawfully and in line with these Terms; you are responsible for the content you translate and how you use the results. Prohibited: abusive, automated or commercial bulk use that is not personal conversation translation; scraping or excessive load; circumventing or manipulating the credit/billing system or fair-use safeguards; reverse engineering, decompiling or disassembling the app except where mandatory law (in particular Sects. 69d and 69e UrhG) allows; and using the service for unlawful, infringing or harmful content. Breaches may lead to measures under Section 11.

6. कीमतें, सदस्यता और इन-ऐप खरीदारी / Pricing, Subscription and In-App Purchases

सेवा का उपयोग एक निःशुल्क कोटे के दायरे में किया जा सकता है: नए खातों को ऑनलाइन उपयोग हेतु एक सीमित निःशुल्क स्वागत-क्रेडिट मिलता है। क्रेडिट समाप्त हो जाने पर ऑनलाइन उपयोग अवरुद्ध हो जाता है; ऑफ़लाइन मोड सदैव निःशुल्क उपलब्ध रहता है।

सशुल्क सेवाएँ हैं:

सभी सशुल्क सेवाएँ विशेष रूप से Apple इन-ऐप खरीदारी (In-App Purchase) के माध्यम से ही खरीदी और बिल की जाती हैं। इस संबंध में भुगतान, बिलिंग, स्वतः नवीकरण और धन-वापसी (रिफंड) के लिए अनुबंध-पक्ष Apple (Apple Distribution International Ltd., आयरलैंड) है, जो उसकी तत्समय लागू शर्तों के अनुसार होता है (देखें अनुभाग 7 भी)। Pro-सदस्यता चयनित अवधि के तत्समय प्रदर्शित मूल्य पर स्वतः उसी अवधि के लिए नवीकृत हो जाती है, बशर्ते कि उसे चालू अवधि की समाप्ति से कम-से-कम 24 घंटे पूर्व रद्द न किया गया हो; नवीकरण का शुल्क चालू अवधि की समाप्ति से 24 घंटे के भीतर लिया जाता है। सदस्यता का प्रबंधन अथवा उसे रद्द करना आप किसी भी समय केवल अपने Apple-डिवाइस की सेटिंग्स में अपने नाम → Subscriptions (सदस्यताएँ) के अंतर्गत ही कर सकते हैं; हमारे माध्यम से प्रबंधन अथवा रद्दीकरण तकनीकी रूप से संभव नहीं है। मूल्य-परिवर्तन Apple के नियमों के अनुसार होते हैं; सहमति-आवश्यक मूल्य-परिवर्तनों के बारे में आपको Apple सूचित करता है। यदि आप Apple से किसी इन-ऐप खरीद के लिए धन-वापसी का अनुरोध करते हैं, तो Apple उस खरीद से संबंधित उपयोग-डेटा हमसे माँग सकता है; आप इससे सहमत हैं कि ऐसी स्थिति में हम Apple को बताएँ कि खरीदी गई सेवा का कितना उपयोग पहले ही हो चुका है, ताकि Apple आपके धन-वापसी अनुरोध पर निर्णय ले सके (विवरण हमारी गोपनीयता नीति में)।

UStG की धारा 19 खंड 1 के अर्थ में लघु-उद्यमी (Kleinunternehmer) होने के नाते हम कोई बिक्री-कर (Umsatzsteuer/VAT) नहीं लेते। चूँकि खरीदारियों के लिए अनुबंध-पक्ष और बिलिंग-इकाई Apple है, इसलिए आपके प्रति Apple द्वारा प्रदर्शित अंतिम कीमतें ही लागू होती हैं।

उचित उपयोग (Fair Use)। LingoShu Pro बातचीत की स्थितियों में सामान्य व्यक्तिगत उपयोग के लिए अभिप्रेत है। सभी उपयोगकर्ताओं के लिए सेवा का दीर्घकालिक रूप से स्थिर और निष्पक्ष संचालन सुनिश्चित करने तथा दुरुपयोग रोकने के लिए, हम यह अधिकार सुरक्षित रखते हैं कि ऐसे उपयोग का — जो स्पष्ट रूप से सामान्य व्यक्तिगत उपयोग के दायरे में न आता हो, जैसे स्वचालित, वाणिज्यिक-रूप से बड़े पैमाने पर अथवा अन्यथा दुरुपयोगपूर्ण उपयोग — उचित सीमा में प्रतिकार करें, अर्थात् ऑनलाइन उपयोग को अस्थायी रूप से धीमा (throttle) कर दें अथवा आपको ऑफ़लाइन मोड की ओर निर्देशित करें। ऐसा कोई उपाय केवल तभी किया जाता है जब वह सेवा को बनाए रखने और दुरुपयोग-रोकथाम के लिए आवश्यक हो तथा आपके लिए सहनीय (zumutbar) हो, और — परिस्थितियों के अनुसार जहाँ तक संभव हो — पूर्व-सूचना के साथ। सामान्य व्यक्तिगत उपयोग इससे प्रभावित नहीं होता; निःशुल्क ऑफ़लाइन मोड हर हाल में उपलब्ध रहता है।

New accounts get limited free welcome credits for online use; when the balance runs out, online use is blocked, while offline mode is always free. Paid options are LingoShu Pro (4.99 EUR/month or 39.99 EUR/year, auto-renewing) and consumable credit packs (one-time purchases, consumed per online use, no cash value, non-transferable). All paid items are bought and billed via Apple In-App Purchase; Apple (Apple Distribution International Ltd., Ireland) handles payment, billing, renewal and refunds. The subscription auto-renews for the chosen period at the displayed price for that period unless cancelled at least 24h before the period ends, and the renewal is charged within 24h before the period ends; you manage or cancel only in your Apple device settings under your name → Subscriptions, not through us. As a small business under Sect. 19 UStG we charge no VAT; Apple's displayed prices apply. If you request a refund from Apple for an in-app purchase, Apple may ask us for consumption information; you agree that we then tell Apple how much of the purchase you have already used so Apple can decide on your refund (details in our Privacy Policy). Fair use: Pro is for ordinary personal conversation use; to keep the service stable for everyone and prevent abuse, we may take proportionate measures (temporarily throttling online use or referring you to offline mode) against use that clearly goes beyond normal personal use, such as automated, commercial bulk or otherwise abusive use, only where necessary and reasonable for you and, where feasible, with notice. Ordinary personal use is not affected; the free offline mode always remains available.

7. निरसन का अधिकार (Widerrufsrecht) / Right of Withdrawal

एक उपभोक्ता के रूप में आपको निरसन (वापस लेने) का वैधानिक अधिकार प्राप्त है। डिजिटल सेवाओं से जुड़े दूरस्थ-विक्रय (Fernabsatz) अनुबंधों में आपको सामान्यतः किसी कारण बताए बिना 14 दिनों के भीतर खरीद को निरस्त करने का अधिकार है। चूँकि आपकी इन-ऐप खरीदारियों के विक्रेता और बिलिंग-इकाई Apple Distribution International Ltd. हैं (देखें अनुभाग 6), इसलिए निरसन व्यावहारिक रूप से Apple के माध्यम से और Apple की शर्तों के अनुसार निपटाया जाता है; यदि आपका कोई प्रश्न हो, तो आप हमसे [email protected] पर संपर्क कर सकते हैं।

डिजिटल सेवाओं के मामले में निरसन का अधिकार वैधानिक शर्तों के अनुसार (BGB की धारा 356 खंड 5) समय-पूर्व समाप्त हो सकता है। जहाँ तक ये शर्तें Apple की खरीद-प्रक्रिया में पूरी होती हैं — अर्थात् आपकी यह स्पष्ट सहमति कि निरसन-अवधि की समाप्ति से पूर्व ही सेवा का निष्पादन प्रारंभ कर दिया जाए, आपकी यह स्पष्ट रूप से पुष्ट जानकारी कि सेवा के पूर्ण निष्पादन पर आप अपना निरसन-अधिकार खो देते हैं, तथा यह सहमति किसी स्थायी डेटा-वाहक (durable medium) पर प्रेषित किया जाना — वहाँ सेवा के पूर्ण निष्पादन के साथ निरसन का अधिकार समाप्त हो जाता है। यह सहमति खरीद-प्रक्रिया में Apple द्वारा प्राप्त की जाती है और प्रेषित की जाती है।

अपने निरसन अथवा धन-वापसी अनुरोध को आप सबसे सरलता से Apple को भेज सकते हैं — reportaproblem.apple.com पर „Problem melden / Report a Problem“ सुविधा के माध्यम से, अथवा Apple Distribution International Ltd., iTunes Store Customer Support, Hollyhill Industrial Estate, Hollyhill, Cork, Ireland को घोषणा द्वारा, [email protected]। इस संबंध में तत्समय लागू Apple Media Services शर्तें मान्य हैं, जिन्हें आप apple.com/legal/internet-services/itunes पर देख सकते हैं। किसी चालू सदस्यता का प्रबंधन अथवा उसे रद्द करना आप अपने Apple-डिवाइस की सेटिंग्स में अपने नाम → Subscriptions (सदस्यताएँ) के अंतर्गत करते हैं।

इसके अतिरिक्त, lingoshu.com/withdrawal पर आपको एक मार्गदर्शिका मिलती है जो आपको Apple की निरसन- और धन-वापसी-सुविधा की ओर निर्देशित करती है। Apple के माध्यम से संपन्न क्रय-अनुबंध के लिए, उसकी प्रक्रिया Apple के माध्यम से ही निर्णायक रहती है।

You have a statutory right of withdrawal. For distance contracts over digital services you generally have the right to withdraw from a purchase within 14 days without giving reasons. Because Apple Distribution International Ltd. is the seller and billing agent of your in-app purchases (see Section 6), withdrawal is processed practically through Apple and under Apple's terms; if you have any questions, you can reach us at [email protected]. For digital services the right can lapse early under Sect. 356 (5) BGB: where the conditions are met in the Apple checkout — your express consent to performance beginning before the withdrawal period ends, your acknowledged awareness that the right lapses on complete performance, and transmission of that consent on a durable medium — the right lapses upon complete performance of the service; Apple obtains and transmits this consent during checkout. To withdraw or request a refund, use Apple's “Report a Problem” (reportaproblem.apple.com) or contact Apple Distribution International Ltd., Cork, Ireland ([email protected]). Manage or cancel a subscription via your Apple device settings under your name → Subscriptions.

8. सेवा की उपलब्धता, अनुरक्षण और परिवर्तन / Availability, Maintenance and Service Changes

हम सेवा को यथासंभव विश्वसनीय रूप से उपलब्ध कराने का प्रयास करते हैं, परंतु निर्बाध (बिना रुकावट) उपलब्धता का दायित्व हम पर नहीं है। उपलब्धता अनुरक्षण-कार्यों, तकनीकी गड़बड़ियों, हमारे प्रभाव-क्षेत्र से बाहर की घटनाओं, तथा तृतीय-पक्ष सेवाओं (विशेष रूप से OpenAI, Apple और Cloudflare) पर निर्भरता और App Store के माध्यम से वितरण के कारण सीमित हो सकती है। आवश्यक अनुरक्षण-कार्य हम यथासंभव कम-उपयोग वाले समय में करते हैं।

हम सेवा को आगे विकसित करने, बेहतर बनाने तथा अलग-अलग सुविधाओं को बदलने या बंद करने के अधिकारी हैं। इसमें ऑनलाइन मोड हेतु प्रयुक्त AI-प्रौद्योगिकियों, मॉडलों और सेवा-प्रदाताओं (वर्तमान में OpenAI) को आगे विकसित करने, अद्यतन (अपडेट) करने अथवा समतुल्य प्रदाताओं से प्रतिस्थापित करने का अधिकार शामिल है, ताकि गुणवत्ता, सुरक्षा और उपलब्धता बनी रहे या बेहतर हो। महत्वपूर्ण, आपके लिए हानिकारक परिवर्तनों अथवा महत्वपूर्ण सुविधाओं को बंद करने के बारे में हम आपको ऐप में अथवा ई-मेल द्वारा उचित पूर्व-सूचना के साथ सूचित करते हैं। ऑनलाइन मोड के लिए चालू इंटरनेट कनेक्शन और संयोजित तृतीय-पक्ष सेवाओं की उपलब्धता आवश्यक है; इसके अतिरिक्त सेवा केवल कुछ निश्चित देशों में ही प्रदान की जाती है (क्षेत्रीय उपलब्धता)।

We aim for reliable availability but do not guarantee uninterrupted service; availability may be limited by maintenance, technical faults, force majeure, dependence on third-party services (OpenAI, Apple, Cloudflare) and App Store distribution. We perform necessary maintenance at low-traffic times where possible. We may further develop, improve, change or discontinue features. This includes the right to evolve, update or replace the AI technologies, models and providers used for the online mode (currently OpenAI) with equivalent providers to maintain or improve quality, security and availability. We will give reasonable advance notice in-app or by email of material changes that disadvantage you or of the discontinuation of essential features. Online mode requires connectivity and third-party availability, and the service is offered in selected countries only.

9. दोष-दायित्व (Gewährleistung) और अद्यतन / Warranty and Updates

सशुल्क डिजिटल उत्पादों पर डिजिटल उत्पादों के अनुबंधों हेतु वैधानिक दोष-अधिकार (BGB की धाराएँ 327 आदि) लागू होते हैं। हम आपको ऐप अथवा सशुल्क सुविधाएँ उत्पाद- और विधिक-दोषों से रहित रूप में उपलब्ध कराते हैं तथा प्रासंगिक अवधि के दौरान वे अद्यतन — जिनमें सुरक्षा-अद्यतन शामिल हैं — उपलब्ध कराते हैं जो अनुबंध-अनुरूपता बनाए रखने के लिए आवश्यक हैं, और इस बारे में आपको सूचित करते हैं। यदि उपलब्ध कराए गए अद्यतन उचित अवधि के भीतर स्थापित नहीं किए जाते, तो ऐसे दोषों के लिए हम उत्तरदायी नहीं हैं जो केवल इसी कारण से उत्पन्न हुए हों, बशर्ते हमने आपको विधिवत सूचित किया हो।

The statutory consumer warranty for digital products (Sect. 327 ff. BGB) applies to paid digital products and is not excluded. We provide the app and paid features free of defects and supply the updates, including security updates, needed to maintain conformity during the relevant period, and inform you about them; if you fail to install provided updates within a reasonable time after proper notice, we are not liable for defects caused solely thereby. Your statutory rights (supplementary performance, termination, price reduction, damages and reimbursement of expenses) remain unaffected. Report defects informally to [email protected]. As described in Section 2, translations are AI-generated and may contain errors, online mode depends on connectivity and third parties, offline mode depends on your device, and Pro is provided within fair, reasonable use — we disclose these characteristics expressly before contract conclusion and agree them as the agreed quality on purchase.

10. दायित्व (Haftung) / Liability

जीवन, शरीर अथवा स्वास्थ्य की हानि से उत्पन्न उन क्षतियों के लिए, जो हमारी, हमारे कानूनी प्रतिनिधियों अथवा निष्पादन-सहायकों की लापरवाहीपूर्ण या साशय कर्तव्य-भंग पर आधारित हों, तथा उन क्षतियों के लिए जो हमारी, हमारे कानूनी प्रतिनिधियों अथवा निष्पादन-सहायकों के साशय (Vorsatz) अथवा घोर लापरवाही (grobe Fahrlässigkeit) पर आधारित हों, हम असीमित रूप से उत्तरदायी हैं। इसी प्रकार हम असीमित रूप से उत्तरदायी हैं जहाँ तक हमने कोई गारंटी ली हो, तथा उत्पाद-दायित्व अधिनियम (Produkthaftungsgesetz) के प्रावधानों के अनुसार।

We are liable without limit for injury to life, body or health caused by any negligent or intentional breach by us, our legal representatives or agents, and for damage caused by our (or their) intent or gross negligence; likewise without limit where we gave a guarantee and under the Product Liability Act. For slightly negligent breach of an essential contractual duty (Kardinalpflicht — a duty whose fulfilment makes proper performance possible and on which you may regularly rely), liability is limited to the foreseeable, contract-typical damage. Otherwise liability for slight negligence is excluded. The above does not shift the burden of proof to your disadvantage, and your statutory digital-product warranty rights (Section 9) remain unaffected. Within these limits we are in particular not liable for the consequences of inaccurate or incomplete translations or transcriptions; see the usage guidance in Section 2. Where the mandatory law of another state applies to you as a consumer and provides non-excludable guarantees or rights (such as the consumer guarantees under the Australian Consumer Law), those remain unaffected; the above limitations apply only to the extent the applicable mandatory law permits, and our liability for breach of such a non-excludable guarantee is limited, where the law allows, at our option to re-supplying the service or paying the cost of re-supply.

11. अनुबंध-अवधि और समाप्ति / Term and Termination

इन उपयोग की शर्तों के गंभीर उल्लंघन की स्थिति में, दुरुपयोगपूर्ण उपयोग की स्थिति में अथवा अवैध आचरण की स्थिति में हम सेवा तक पहुँच को पूर्णतः अथवा आंशिक रूप से अवरुद्ध, सीमित या समाप्त कर सकते हैं। ऐसे उपाय आनुपातिक रूप से और — परिस्थितियों के अनुसार जहाँ तक संभव और सहनीय हो — पूर्व-सूचना के साथ किए जाते हैं। किसी अवरोधन (ब्लॉक) के बारे में हम आपको, जहाँ तक संभव हो, ऐप में सूचित करते हैं। यदि आप किसी अवरोधन से असहमत हैं, तो आप उसका विरोध कर सकते हैं और पुनर्विचार की माँग कर सकते हैं, हमसे [email protected] पर संपर्क करके — तब भी जब आप ऐप पहले ही अनइंस्टॉल कर चुके हों; हम आपके विरोध की जाँच करते हैं और परिणाम आपको बताते हैं। महत्वपूर्ण कारण से असाधारण समाप्ति (außerordentliche Kündigung) का अधिकार तथा अन्य वैधानिक समाप्ति-अधिकार दोनों पक्षों के लिए अप्रभावित रहते हैं।

The use contract runs indefinitely while your account exists. The Pro subscription's term and renewal run via Apple (Section 6); you can cancel anytime in your Apple device settings under your name → Subscriptions, effective at the end of the current paid period. You can delete your account anytime in the app (Settings → “Delete Account”), which ends the use contract; the Privacy Policy describes what remains after deletion (notably an irreversible abuse-prevention hash). Cancel any active Apple subscription separately in your Apple device settings under your name → Subscriptions. We may suspend, restrict or terminate access for serious breach, abuse or unlawful conduct, proportionately and, where feasible, with prior notice. We notify you of a suspension in the app where possible; if you disagree, you may object and request a review by emailing [email protected] — also if you have already uninstalled the app — and we will review it and inform you of the outcome. Statutory and good-cause termination rights remain unaffected for both sides.

12. उपभोक्ता-विवाद समाधान / Consumer Dispute Resolution

हम किसी उपभोक्ता-मध्यस्थता निकाय (Verbraucherschlichtungsstelle) के समक्ष विवाद-समाधान कार्यवाहियों में भाग लेने के लिए न तो तैयार हैं और न ही बाध्य हैं।

We are not willing or obliged to participate in dispute settlement procedures before a consumer arbitration board.

13. इन उपयोग की शर्तों में परिवर्तन / Changes to these Terms

इन उपयोग की शर्तों में परिवर्तन आपको उनके प्रभावी होने से कम-से-कम छह सप्ताह पूर्व पाठ-रूप में (उदा. ई-मेल द्वारा अथवा ऐप में सूचना द्वारा) प्रस्तावित किए जाते हैं। हम ऐसे परिवर्तन आपको केवल उस सीमा तक प्रस्तावित करते हैं जहाँ तक वे इन उपयोग की शर्तों को बदले हुए कानूनी अथवा सर्वोच्च-न्यायालयी प्रावधानों के अनुरूप ढालने, तकनीकी या सुरक्षा-संबंधी समायोजन लागू करने, अथवा ऐप की ऐसी नई सुविधाओं को समाहित करने के लिए आवश्यक हो जाएँ जो आपके लिए हानिकारक न हों या जो गैर-आवश्यक हों, और जहाँ तक परिवर्तन प्रतिफल-और-प्रतिप्रदान (Leistung और Gegenleistung) के संतुलन को आपके प्रतिकूल न बदले, देय सेवा-दायरे को आपके प्रतिकूल कम न करे, और आपको अनुचित रूप से नुकसान न पहुँचाए।

कीमत में परिवर्तन, सेवा के मुख्य-विषय में परिवर्तन तथा देय सेवा-दायरे में महत्वपूर्ण, आपके लिए हानिकारक परिवर्तन इस सहमति-कल्पना (Zustimmungsfiktion) के माध्यम से नहीं किए जाते; इनके लिए हम आपकी स्पष्ट सहमति प्राप्त करते हैं, अथवा ये App Store में एक नए प्रस्ताव के माध्यम से किए जाते हैं।

We will offer you changes to these Terms in text form (e.g. email or in-app) at least six weeks before they take effect, and only where needed to adapt to changed legal or supreme-court requirements, to make technical or security adjustments, or to reflect new features that are not disadvantageous to you or are non-essential, and only where the change does not shift the price–performance balance to your disadvantage, does not reduce the owed scope of service to your disadvantage, and does not unreasonably disadvantage you. Your consent is deemed given if you do not object before the proposed effective date; we will specifically point out this effect of silence and your right to object and to terminate. If you object, you may terminate free of charge and without notice period until the change takes effect; otherwise the change takes effect. Price changes, changes to the main subject matter and material disadvantageous changes to the owed scope of service are not made by this deemed-consent mechanism — for those we obtain your express consent or they run via a new App Store offer.

14. लागू कानून और न्यायाधिकार / Governing Law and Jurisdiction

जर्मनी संघीय गणराज्य (Bundesrepublik Deutschland) का कानून लागू होता है। यदि एक उपभोक्ता के रूप में आपका सामान्य निवास किसी अन्य राज्य में है, तो उस राज्य के कानून के अनिवार्य प्रावधानों द्वारा आपको प्रदत्त वह संरक्षण, जिनसे समझौते द्वारा विचलन नहीं किया जा सकता, इस कानून-चयन से अप्रभावित रहता है (रोम-I-विनियमन का अनुच्छेद 6 खंड 2)।

German law applies. If, as a consumer, you have your habitual residence in another state, the protection of the mandatory provisions of that state's law from which no agreement may derogate remains unaffected by this choice of law (Art. 6 (2) Rome I). We do not impose any jurisdiction agreement to your disadvantage as a consumer; the statutory rules on local and international jurisdiction apply.

15. Apple-विशिष्ट प्रावधान / Apple-Specific Terms

निम्नलिखित प्रावधान शेष अनुभागों के पूरक हैं और Apple के संबंध में लागू होते हैं। उपर्युक्त अनुभागों के साथ विरोधाभास की स्थिति में, जहाँ तक ये Apple से संबंधित हों, निम्नलिखित Apple-विशिष्ट न्यूनतम-शर्तों को प्राथमिकता मिलती है।

These Apple-specific minimum terms supplement the rest. These Terms are between you and us only, not Apple, and we alone are responsible for the app and its content; Apple merely provides the App Store. The licence (Section 4) is limited, non-transferable, non-exclusive and for use on Apple devices you own or control under Apple's Usage Rules, with shared use as the Usage Rules permit (including Apple Family Sharing). We are solely responsible for any maintenance and support; Apple has no such obligation. We, not Apple, bear the statutory warranty for the app; if the app fails to conform to a warranty you may notify Apple, and Apple will refund the purchase price you paid, if any (including for in-app purchases such as the Pro subscription or credit packs), with no other warranty obligation to the maximum extent permitted by law — all further claims are our responsibility, and your statutory rights under Sect. 327 ff. BGB against us (Section 9) remain unaffected. We, not Apple, address product-liability claims, claims that the app fails to meet legal/regulatory requirements, and consumer-protection/privacy claims, and we alone handle any third-party intellectual-property claims. You must comply with applicable third-party terms (e.g. your mobile data plan). As required by Apple, you confirm that you are not located in a U.S.-embargoed or “terrorist-supporting” country and are not on any U.S. prohibited/restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. अंतिम प्रावधान / Final Provisions

यदि इन उपयोग की शर्तों का कोई प्रावधान अप्रभावी (अमान्य) हो या हो जाए, तो शेष प्रावधानों की प्रभावशीलता अप्रभावित रहती है। किसी अप्रभावी अथवा अनुपस्थित प्रावधान के स्थान पर वैधानिक प्रावधान लागू होते हैं।
