1. 適用範圍、供應者與契約相對人 / Scope, Provider, Contracting Party
本使用條款(以下簡稱「使用條款」)適用於 iOS 應用程式「LingoShu Translator」(以下簡稱「本應用程式」)及網站 lingoshu.com(以下合稱「本服務」)之使用。本使用條款規範您(使用者,以下簡稱「您」)與供應者之間的關係,同時包含本應用程式的終端使用者授權條款(第 4 條與第 15 條)。
就本服務之使用,供應者與契約相對人為:

These Terms govern your use of the LingoShu Translator app and the lingoshu.com website and also contain the end-user licence terms for the app (Sections 4 and 15). The provider and your contracting party for use of the service is VinLihs Digital Services, owner Vincent Leinhos, Mainzer Landstr. 148, 60327 Frankfurt am Main, Germany ([email protected]). The service is offered to consumers only. These Terms are concluded between you and us, not with Apple — Apple only operates the App Store through which you obtained the app (the app is currently distributed exclusively via the Apple App Store). Together with our Privacy Policy and Legal Notice (Impressum), these Terms form the legal basis of your use; for data-processing questions the Privacy Policy prevails. You can view, save and print these Terms at lingoshu.com/terms. By creating an account or using the service you accept these Terms.
2. 契約標的與服務說明 / Subject Matter and Description of Service
LingoShu Translator 是一款由 AI 輔助、供兩人面對面個人對話使用的語音翻譯應用程式。兩位對話夥伴各自選擇語言,進行錄音並說話;本應用程式會將所說內容轉錄為文字並予以翻譯。本服務支援多種語言;最新的語言清單請見本應用程式內。
本應用程式提供兩種運作模式:
- 線上模式:您的語音錄音會透過我們的後端轉送至 OpenAI 的介面(用於語音辨識與翻譯)。此模式可提供最高的品質,但需要既有的網際網路連線,以及我們所串接之第三方服務(特別是 OpenAI)的可用性。在此過程中,音訊與逐字稿不會儲存於我們的伺服器上,而僅於記憶體中處理,並於請求結束後即予捨棄(參見隱私權政策)。
- 離線模式:語音辨識與翻譯完全在您的裝置上進行,使用 Apple 自有的框架。在此模式下,音訊與文字均不會離開您的裝置。哪些語言配對可於離線使用,取決於您的 Apple 裝置之支援情形。
關於品質性狀之重要提示:翻譯與轉錄係借助人工智慧以機器方式產生。如同任何自動翻譯,其可能含有不準確、錯誤或不符脈絡之用語。本服務係供輔助日常個人對話之用。其並非供作、亦不適合在醫療、法律、行政、財務或其他攸關安全之情境以及緊急情況下,作為可信賴之翻譯使用——於此等情況下,錯誤可能導致損害。於此等情形,請尋求合格之專業人員或人工譯者協助。此種借助人工智慧以機器方式產生翻譯,乃本服務之約定性狀(參見第 9 條);您的法定瑕疵權利不受影響。
本服務僅於特定國家提供。來自未開放地區之請求將遭拒絕(地區可用性,參見第 8 條與隱私權政策)。
LingoShu provides AI-assisted speech translation for one-to-one conversations in a range of languages (see the current list in the App), in two modes: an Online mode (audio is sent via our backend to OpenAI's APIs for speech recognition and translation; it needs connectivity and third-party availability, and audio/transcripts are processed in memory only, not stored on our servers) and an Offline mode (fully on-device via Apple's frameworks; nothing leaves your device, subject to device support for the language pair). Translations are machine-generated by AI and may be inaccurate or incomplete. The service is for everyday conversation and must not be relied upon in medical, legal, official, financial or safety-critical situations or emergencies where errors could cause harm — use a qualified professional there. This AI-based generation is an agreed quality of the service (see Section 9); your statutory warranty rights remain unaffected. The service is offered in selected countries only.
3. 契約成立、帳號與使用資格 / Contract Formation, Account, Eligibility
欲使用本服務,您須以「Sign in with Apple」(透過 Apple 登入)登入。在此過程中,我們僅自 Apple 取得一組不透明的使用者識別碼;我們既不取得您的姓名,也不取得您的電子郵件地址(細節請見隱私權政策)。一經首次登入並建立帳號,您與我們之間關於使用本服務之契約即告成立。
本服務允許年滿 13 歲之人使用。若您居住國家/地區之法律就使用本服務或就有效同意規定有更高之最低年齡,則適用該年齡。13 歲至 18 歲之未成年人,僅得在法定代理人同意之下,或在其可自由處分之金錢範圍內(德國《民法典》第 110 條),購買付費功能(特別是 Pro 訂閱與點數方案)。一經進行付費購買,即表示您保證上述要件均已具備。
每位使用者僅設一個帳號。您有責任妥善保護對您 Apple 帳號之存取,並因而保護對您 LingoShu 帳號之存取。
You sign in with Apple; we receive only an opaque identifier, not your name or email. The use contract is formed when you first create an account. The minimum age to use the service is 13; where the law of your country of residence sets a higher minimum age, that higher age applies. Minors aged 13–18 may buy paid features (Pro subscription, credit packs) only with the consent of a legal guardian or within means left to their free disposal (Sect. 110 BGB); by making a paid purchase you confirm this. One account per user; you are responsible for protecting access to your Apple account.
4. 使用權(授權) / Licence
我們授予您一項單純(非專屬)、不可移轉,且以契約存續期間為限之權利,得將本應用程式用於個人、非商業之對話翻譯。此授權適用於您所擁有或控制之所有 Apple 裝置上之使用,且須完全依《Apple 媒體服務條款》之使用規則為之。不得於您並不擁有或控制之裝置上使用,亦不得透過網路散布以供多部裝置同時使用;於使用規則(特別是家人共享)所允許之範圍內,共同使用係屬許可。
本授權之終止,依第 11 條(特別是於發生重大違約時)以及法律規定為之;我們並未保留得任意撤回授權之自由權利。
本應用程式之一切權利,包括所有著作權、商標權及其他保護權利,均歸屬於我們或我們的授權人。於離線模式所使用之語音與翻譯模型歸屬於 Apple,並受其條款規範。除本使用條款明文授予之權利外,本應用程式之任何權利均不移轉予您。
We grant you a limited, non-exclusive, non-transferable licence, limited to the term of the contract, to use the app for personal, non-commercial conversation translation on any Apple device you own or control, consistent with the Usage Rules of Apple's Media Services Terms (no use on devices you do not own/control; no network distribution for simultaneous multi-device use; shared use is permitted as the Usage Rules permit, including Apple Family Sharing). Any termination of this licence follows Section 11 (in particular for serious breach) and statutory law; we do not reserve a free right to revoke the licence at will. All intellectual property in the app remains with us or our licensors; the offline language models belong to Apple and are subject to Apple's terms. No rights beyond those expressly granted are transferred.
5. 使用者義務與行為規範 / User Obligations and Acceptable Use
您僅得在符合適用法律及本使用條款之前提下使用本服務。您須就您所請求翻譯之內容,以及您運用翻譯結果之方式,獨自負責。
以下行為尤其不予許可:
- 以濫用、自動化、商業性大量,或其他非為個人對話翻譯之方式使用本服務;
- 以自動化方式擷取本服務之資料(scraping),或以不當之高流量耗用本服務;
- 規避、操縱或使點數/帳務系統,或為確保公平使用所設之防護措施失其效用;
- 對本應用程式進行還原工程(Reverse Engineering)、反編譯或反組譯,但以強制性法律——特別是著作權法(UrhG)第 69d 條與第 69e 條——明文允許者為限;
- 利用本服務產生、傳輸或散布違法、侵權或有害之內容。
違反上述義務者,得導致第 11 條所定之措施。
Use the service only lawfully and in line with these Terms; you are responsible for the content you translate and how you use the results. Prohibited: abusive, automated or commercial bulk use that is not personal conversation translation; scraping or excessive load; circumventing or manipulating the credit/billing system or fair-use safeguards; reverse engineering, decompiling or disassembling the app except where mandatory law (in particular Sects. 69d and 69e UrhG) allows; and using the service for unlawful, infringing or harmful content. Breaches may lead to measures under Section 11.
6. 價格、訂閱與 App 內購買 / Pricing, Subscription and In-App Purchases
本服務可於免費額度範圍內使用:新帳號會獲得一份有限的免費歡迎點數,供線上使用。點數用罄後,線上使用將遭封鎖;離線模式則始終可免費使用。
付費項目為:
- LingoShu Pro —— 一項自動週期性續訂之訂閱,價格為每月 4,99 歐元或每年 39,99 歐元。
- 點數方案(Coins/分鐘數) —— 可消耗點數之單次購買,每次線上轉錄或翻譯時消耗。所購得之點數不具現金價值,且不可移轉。
所有付費項目均僅透過 Apple App 內購買進行購買與結帳。就此而言,付款、結帳、自動續訂與退款之契約相對人為 Apple(Apple Distribution International Ltd.,愛爾蘭),並依各該適用之 Apple 條款辦理(並參見第 7 條)。Pro 訂閱會自動依各所選之週期、以該週期各所顯示之價格續訂,除非於當期屆滿前至少 24 小時取消;續訂之扣款於當期結束前 24 小時內進行。您隨時僅得於您 Apple 裝置之設定中、於您的名稱 → 訂閱項目下管理或取消訂閱;透過我們進行管理或取消在技術上並不可行。價格變更依 Apple 之規則辦理;就須經同意之價格變更,Apple 會通知您。若您就某筆 App 內購買向 Apple 申請退款,Apple 得向我們查詢關於該筆購買之使用資料;您同意我們於此情形下向 Apple 傳送所購得之服務已使用之程度,俾使 Apple 得就您的退款申請作出決定(細節請見我們的隱私權政策)。
作為德國《加值稅法》(UStG)第 19 條第 1 項意義下之小型企業者,我們不另收加值稅。由於 Apple 為各筆購買之契約相對人與結帳機構,對您適用者為 Apple 所顯示之最終價格。
公平使用。LingoShu Pro 係供對話情境中之一般個人使用。為確保對所有使用者持續穩定且公平之營運並防止濫用,我們保留就明顯非屬正常個人使用所涵蓋之使用——例如自動化、商業性大量或其他濫用之使用——於適當範圍內予以因應之權利,方式為暫時對線上使用予以限速,或引導改用離線模式。此等措施僅於為維持本服務及防止濫用所必要、且對您屬可期待者之範圍內為之,並——於依情況屬可行者——附帶事先告知。正常個人使用不受此影響;免費的離線模式在任何情形下均仍可使用。
New accounts get limited free welcome credits for online use; when the balance runs out, online use is blocked, while offline mode is always free. Paid options are LingoShu Pro (4.99 EUR/month or 39.99 EUR/year, auto-renewing) and consumable credit packs (one-time purchases, consumed per online use, no cash value, non-transferable). All paid items are bought and billed via Apple In-App Purchase; Apple (Apple Distribution International Ltd., Ireland) handles payment, billing, renewal and refunds. The subscription auto-renews for the chosen period at the displayed price for that period unless cancelled at least 24h before the period ends, and the renewal is charged within 24h before the period ends; you manage or cancel only in your Apple device settings under your name → Subscriptions, not through us. As a small business under Sect. 19 UStG we charge no VAT; Apple's displayed prices apply. If you request a refund from Apple for an in-app purchase, Apple may ask us for consumption information; you agree that we then tell Apple how much of the purchase you have already used so Apple can decide on your refund (details in our Privacy Policy). Fair use: Pro is for ordinary personal conversation use; to keep the service stable for everyone and prevent abuse, we may take proportionate measures (temporarily throttling online use or referring you to offline mode) against use that clearly goes beyond normal personal use, such as automated, commercial bulk or otherwise abusive use, only where necessary and reasonable for you and, where feasible, with notice. Ordinary personal use is not affected; the free offline mode always remains available.
7. 撤回權 / Right of Withdrawal
作為消費者,您享有法定之撤回權。就數位服務之遠距契約,您原則上有權於 14 日內無須說明理由撤回購買。由於 Apple Distribution International Ltd. 為您 App 內購買之賣方與結帳機構(參見第 6 條),撤回實務上係透過 Apple、並依 Apple 之條款處理;如有任何疑問,您可透過 [email protected] 與我們聯絡。
就數位服務,撤回權得依法定要件(德國《民法典》第 356 條第 5 項)提前消滅。於 Apple 購買程序中具備該等要件之情形下——即您明確同意於撤回期間屆滿前開始履行、您明確確認知悉於服務完整履行時將喪失撤回權,以及該同意係以持久性媒介傳輸——撤回權於服務完整履行時消滅。此項同意係於購買程序中由 Apple 取得並傳輸。
您的撤回或退款申請,最簡便者係向 Apple 提出——透過 reportaproblem.apple.com 上之「回報問題」功能,或以向 Apple Distribution International Ltd., iTunes Store Customer Support, Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, [email protected] 所為之表示提出。以各該適用之《Apple 媒體服務條款》為準,您可於 apple.com/legal/internet-services/itunes 查閱該等條款。既有之訂閱,您可於您 Apple 裝置之設定中、於您的名稱 → 訂閱項目下管理或取消。
此外,您可於 lingoshu.com/withdrawal 取得指引,該指引會引導您前往 Apple 的撤回與退款功能。惟就透過 Apple 所締結之買賣契約,仍以透過 Apple 之處理為準。
You have a statutory right of withdrawal. For distance contracts over digital services you generally have the right to withdraw from a purchase within 14 days without giving reasons. Because Apple Distribution International Ltd. is the seller and billing agent of your in-app purchases (see Section 6), withdrawal is processed practically through Apple and under Apple's terms; if you have any questions, you can reach us at [email protected]. For digital services the right can lapse early under Sect. 356 (5) BGB: where the conditions are met in the Apple checkout — your express consent to performance beginning before the withdrawal period ends, your acknowledged awareness that the right lapses on complete performance, and transmission of that consent on a durable medium — the right lapses upon complete performance of the service; Apple obtains and transmits this consent during checkout. To withdraw or request a refund, use Apple's “Report a Problem” (reportaproblem.apple.com) or contact Apple Distribution International Ltd., Cork, Ireland ([email protected]). Manage or cancel a subscription via your Apple device settings under your name → Subscriptions.
8. 服務之可用性、維護與變更 / Availability, Maintenance and Service Changes
我們致力於盡可能可靠地提供本服務,惟不負擔不間斷之可用性。可用性可能因維護作業、技術故障、非我們所能影響之事件,以及對第三方服務(特別是 OpenAI、Apple 與 Cloudflare)之依賴及透過 App Store 之散布而受限。必要之維護作業,我們會盡可能於使用量較低之時段進行。
我們得對本服務持續開發、改善,並變更或停止個別功能。此包括為維持或改善品質、安全性與可用性,而對線上模式所採用之 AI 技術、模型與服務商(目前為 OpenAI)持續開發、更新或以同等供應商替換之權利。就對您不利之重大變更,或就重要功能之停止,我們會以合理之事先告知、於本應用程式內或以電子郵件通知您。線上模式須以既有之網際網路連線及所串接第三方服務之可用性為前提;此外,本服務僅於特定國家提供(地區可用性)。
We aim for reliable availability but do not guarantee uninterrupted service; availability may be limited by maintenance, technical faults, force majeure, dependence on third-party services (OpenAI, Apple, Cloudflare) and App Store distribution. We perform necessary maintenance at low-traffic times where possible. We may further develop, improve, change or discontinue features. This includes the right to evolve, update or replace the AI technologies, models and providers used for the online mode (currently OpenAI) with equivalent providers to maintain or improve quality, security and availability. We will give reasonable advance notice in-app or by email of material changes that disadvantage you or of the discontinuation of essential features. Online mode requires connectivity and third-party availability, and the service is offered in selected countries only.
9. 瑕疵擔保與更新 / Warranty and Updates
就付費之數位產品,適用關於數位產品契約之法定瑕疵權利(德國《民法典》第 327 條以下)。我們提供之本應用程式或付費功能將無產品瑕疵及權利瑕疵,並於相關期間內提供為維持契約相符性所必要之更新(包括安全性更新),且就此通知您。若您未於合理期間內安裝所提供之更新,就僅因此而生之瑕疵,於我們已適當通知您之前提下,我們不負責任。
您於補正履行、契約終止、減價以及損害賠償與費用償還之法定權利不受影響;對消費者並不排除此等權利。
您可不拘形式地透過 [email protected] 向我們申告瑕疵。我們另提醒您注意第 2 條所述之性狀:翻譯係借助人工智慧以機器方式產生,並可能含有不準確之處;線上模式須以連線及第三方服務為前提,離線模式則取決於裝置;Pro 訂閱係於適當、公平使用之範圍內提供。就此等偏離通常可期待者之特性,我們於此在契約成立前向您明確且個別地提示;一經完成購買,我們即明確約定此等性狀。
The statutory consumer warranty for digital products (Sect. 327 ff. BGB) applies to paid digital products and is not excluded. We provide the app and paid features free of defects and supply the updates, including security updates, needed to maintain conformity during the relevant period, and inform you about them; if you fail to install provided updates within a reasonable time after proper notice, we are not liable for defects caused solely thereby. Your statutory rights (supplementary performance, termination, price reduction, damages and reimbursement of expenses) remain unaffected. Report defects informally to [email protected]. As described in Section 2, translations are AI-generated and may contain errors, online mode depends on connectivity and third parties, offline mode depends on your device, and Pro is provided within fair, reasonable use — we disclose these characteristics expressly before contract conclusion and agree them as the agreed quality on purchase.
10. 責任 / Liability
就因我們、我們的法定代理人或履行輔助人之過失或故意違反義務所致對生命、身體或健康之侵害而生之損害,以及就因我們、我們的法定代理人或履行輔助人之故意或重大過失所致之損害,我們負無限制之責任。於我們承擔保證之範圍內,以及依《產品責任法》之規定,我們同樣負無限制之責任。
於輕過失違反主要契約義務之情形,我們之責任於數額上以契約成立時可預見之、契約典型之損害為限。主要契約義務(基本義務,Kardinalpflichten)係指其履行始能使契約之妥適執行成為可能、且您通常得信賴其受遵守之義務。除此之外,我們就輕過失之責任予以排除。
上述規定並不伴隨將舉證責任變更為對您不利。關於數位產品之法定瑕疵權利(德國《民法典》第 327 條以下,第 9 條)不受影響。於上述責任規定之範圍內,我們尤其不就不準確或不完整之翻譯或轉錄之後果負責;就此請注意第 2 條之使用提示。於對作為消費者之您適用其他國家之強制性法律、且該法律規定有不可排除之瑕疵擔保或保證(例如澳洲《消費者法》(Australian Consumer Law)下之消費者保證)之範圍內,該等規定不受影響;上述責任限制僅於所適用之強制性法律所允許之範圍內適用,且我們就違反此類不可排除保證之責任——於法律所允許之範圍內——以我們之選擇為準,限於重新提供服務或償還重新提供之費用。
We are liable without limit for injury to life, body or health caused by any negligent or intentional breach by us, our legal representatives or agents, and for damage caused by our (or their) intent or gross negligence; likewise without limit where we gave a guarantee and under the Product Liability Act. For slightly negligent breach of an essential contractual duty (Kardinalpflicht — a duty whose fulfilment makes proper performance possible and on which you may regularly rely), liability is limited to the foreseeable, contract-typical damage. Otherwise liability for slight negligence is excluded. The above does not shift the burden of proof to your disadvantage, and your statutory digital-product warranty rights (Section 9) remain unaffected. Within these limits we are in particular not liable for the consequences of inaccurate or incomplete translations or transcriptions; see the usage guidance in Section 2. Where the mandatory law of another state applies to you as a consumer and provides non-excludable guarantees or rights (such as the consumer guarantees under the Australian Consumer Law), those remain unaffected; the above limitations apply only to the extent the applicable mandatory law permits, and our liability for breach of such a non-excludable guarantee is limited, where the law allows, at our option to re-supplying the service or paying the cost of re-supply.
11. 契約期間與終止 / Term and Termination
關於使用本服務之契約,於您的帳號存續期間無限期延續。Pro 訂閱之期間與自動續訂,依您透過 Apple 所為之購買辦理(第 6 條)。您可隨時於您 Apple 裝置之設定中、於您的名稱 → 訂閱項目下取消訂閱;取消於當期已付費週期結束時生效。
您可隨時於本應用程式中刪除您的帳號(設定 →「Delete Account」);一經刪除,關於使用本應用程式之契約即告終止。刪除後尚存留之資料(特別是一組為防止濫用而設、不可逆之雜湊值),於隱私權政策中有所說明。任何仍在進行中之 Apple 訂閱關係,請另行於您 Apple 裝置之設定中、於您的名稱 → 訂閱項目下取消。
於發生對本使用條款之重大違反、濫用使用或違法行為時,我們得就本服務之存取為全部或一部之封鎖、限制或終止。此等措施須合乎比例,並——於依情況屬可行且可期待者——附帶事先告知。就封鎖,我們會於可能之範圍內於本應用程式中通知您。若您不同意某項封鎖,您可對其表示異議並要求覆核,方式為透過 [email protected] 與我們聯絡——即使您已將本應用程式解除安裝亦然;我們會審查您的異議並將結果告知您。雙方因重大事由而為非常終止之權利,以及其他法定終止權,均不受影響。
The use contract runs indefinitely while your account exists. The Pro subscription's term and renewal run via Apple (Section 6); you can cancel anytime in your Apple device settings under your name → Subscriptions, effective at the end of the current paid period. You can delete your account anytime in the app (Settings → “Delete Account”), which ends the use contract; the Privacy Policy describes what remains after deletion (notably an irreversible abuse-prevention hash). Cancel any active Apple subscription separately in your Apple device settings under your name → Subscriptions. We may suspend, restrict or terminate access for serious breach, abuse or unlawful conduct, proportionately and, where feasible, with prior notice. We notify you of a suspension in the app where possible; if you disagree, you may object and request a review by emailing [email protected] — also if you have already uninstalled the app — and we will review it and inform you of the outcome. Statutory and good-cause termination rights remain unaffected for both sides.
12. 消費爭議解決 / Consumer Dispute Resolution
我們無意願亦無義務參與消費者調解機構之爭議解決程序。
We are not willing or obliged to participate in dispute settlement procedures before a consumer arbitration board.
13. 本使用條款之變更 / Changes to these Terms
本使用條款之變更,最遲於其生效前六週,以文字形式(例如以電子郵件或以本應用程式內之通知)向您提出。我們僅於下列情形且範圍內向您提出此類變更:為使本使用條款適應已變更之法律或最高法院判例之要求、為實施技術或安全相關之調整,或為反映本應用程式對您不利或非屬重大之新功能;且僅於該變更不致將給付與對待給付之關係變更為對您不利、不致將所負擔之給付範圍縮減為對您不利,且不致使您受不當不利益之範圍內為之。
若您未於所提議之變更生效時點前向我們表示拒絕,即視為您已同意。就您之沉默所生之此項同意效果,以及就您之異議權與終止權,我們將於變更提議中另行向您提示。若您對變更表示異議,您得於變更生效前隨時免費且無須遵守終止預告期間終止契約;除此之外,該變更即生效力。

We will offer you changes to these Terms in text form (e.g. email or in-app) at least six weeks before they take effect, and only where needed to adapt to changed legal or supreme-court requirements, to make technical or security adjustments, or to reflect new features that are not disadvantageous to you or are non-essential, and only where the change does not shift the price–performance balance to your disadvantage, does not reduce the owed scope of service to your disadvantage, and does not unreasonably disadvantage you. Your consent is deemed given if you do not object before the proposed effective date; we will specifically point out this effect of silence and your right to object and to terminate. If you object, you may terminate free of charge and without notice period until the change takes effect; otherwise the change takes effect. Price changes, changes to the main subject matter and material disadvantageous changes to the owed scope of service are not made by this deemed-consent mechanism — for those we obtain your express consent or they run via a new App Store offer.
14. 適用法律與管轄法院 / Governing Law and Jurisdiction
適用德意志聯邦共和國之法律。若作為消費者之您於另一國家有其慣常居所,則該國法律之強制性規定(且不得以約定予以背離者)所賦予您之保護,不因此項法律選擇而受影響(《羅馬第一規則》第 6 條第 2 項)。
我們不會就管轄法院作成偏離法定規定、且對作為消費者之您不利之合意;適用關於土地管轄與國際管轄之法定規定。
German law applies. If, as a consumer, you have your habitual residence in another state, the protection of the mandatory provisions of that state's law from which no agreement may derogate remains unaffected by this choice of law (Art. 6 (2) Rome I). We do not impose any jurisdiction agreement to your disadvantage as a consumer; the statutory rules on local and international jurisdiction apply.
15. Apple 特別條款 / Apple-Specific Terms
以下條款補充其餘各條,並適用於與 Apple 之關係。如與前述各條相牴觸,於涉及 Apple 之範圍內,以下列 Apple 特別最低條款為準。
- 契約當事人。本使用條款僅於您與我們之間成立,而非與 Apple 成立。就 LingoShu Translator 應用程式及其內容,僅由我們負責。Apple 僅提供您用以取得本應用程式的 App Store。
- 授權範圍。依第 4 條所授予之授權為有限、不可移轉且非專屬,並適用於您所擁有或控制之所有 Apple 裝置上對本應用程式之使用,且須完全依《Apple 媒體服務條款》之使用規則為之;於使用規則(特別是家人共享)所允許之範圍內,共同使用係屬許可。
- 維護與支援。於本條款或依適用法律所要求之範圍內,就 LingoShu Translator 之任何維護與支援服務,僅由我們負責。您與我們知悉,Apple 並不負任何就本應用程式提供維護或支援服務之義務。支援請洽 [email protected]。
- 瑕疵擔保與 Apple 退款。就本應用程式之法定瑕疵擔保,僅由我們——而非 Apple——承擔。若 LingoShu Translator 不符合某項適用之瑕疵擔保,您可向 Apple 申告;於此情形,Apple 會就您可能已支付之購買價金退款予您(包括就 App 內購買,如 Pro 訂閱或點數方案)。於法律所允許之最大範圍內,Apple 此外不負任何進一步之瑕疵擔保義務;因不符合而生之一切其他請求、損失、責任、損害、成本或費用,均由我們單獨負責。您依德國《民法典》第 327 條以下對我們所享有之法定瑕疵權利(第 9 條)不受影響。
- 產品及其他請求。就您或第三方提出之、與 LingoShu Translator 或您對本應用程式之持有及使用相關之請求之處理,由我們——而非 Apple——負責,包括但不限於產品責任請求、因不符合法律或法規要求而生之請求,以及依消費者保護或資料保護法令而生之請求。
- 智慧財產權。若有第三方主張 LingoShu Translator 或您對本應用程式之持有及使用侵害其智慧財產權,就此類請求之調查、抗辯、和解與處理,僅由我們——而非 Apple——負責。
- 第三方條款。於使用 LingoShu Translator 時,您須遵守適用之第三方條款(例如於使用本應用程式時,您不得違反您的行動數據費率方案)。
- 出口法令之遵循。此項確認係 Apple 所要求:一經使用,即表示您確認(i)您並非位於受美國政府禁運,或經美國政府認定為「支持恐怖主義」之國家,且(ii)您未被列於任何美國政府關於受禁止或受限制當事人之清單上(包括美國財政部之「特別指定國民」(Specially Designated Nationals)清單,以及美國商務部之「拒絕往來人員清單」(Denied Persons List)或「實體清單」(Entity List))。
- Apple 為受益第三人。Apple 及 Apple 之子公司為本使用條款之受益第三人。一經您接受本條款,Apple 即有權(並視為有權接受此項權利)作為受益第三人,對您執行本使用條款。
These Apple-specific minimum terms supplement the rest. These Terms are between you and us only, not Apple, and we alone are responsible for the app and its content; Apple merely provides the App Store. The licence (Section 4) is limited, non-transferable, non-exclusive and for use on Apple devices you own or control under Apple's Usage Rules, with shared use as the Usage Rules permit (including Apple Family Sharing). We are solely responsible for any maintenance and support; Apple has no such obligation. We, not Apple, bear the statutory warranty for the app; if the app fails to conform to a warranty you may notify Apple, and Apple will refund the purchase price you paid, if any (including for in-app purchases such as the Pro subscription or credit packs), with no other warranty obligation to the maximum extent permitted by law — all further claims are our responsibility, and your statutory rights under Sect. 327 ff. BGB against us (Section 9) remain unaffected. We, not Apple, address product-liability claims, claims that the app fails to meet legal/regulatory requirements, and consumer-protection/privacy claims, and we alone handle any third-party intellectual-property claims. You must comply with applicable third-party terms (e.g. your mobile data plan). As required by Apple, you confirm that you are not located in a U.S.-embargoed or “terrorist-supporting” country and are not on any U.S. prohibited/restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. 最終條款 / Final Provisions
本使用條款之某項規定縱屬無效或嗣後成為無效,其餘規定之效力不受影響。無效或欠缺之規定,由法定規定取而代之。
與本使用條款相關之通知與表示,請寄至 [email protected]。本使用條款連同隱私權政策(lingoshu.com/privacy)與法律聲明(Impressum,lingoshu.com/impressum),共同構成您與我們之間關於使用本服務之協議。
生效日期:2026 年 6 月 28 日。
If any provision of these Terms is or becomes invalid, the remaining provisions stay valid; the statutory rules replace an invalid or missing provision. Send notices relating to these Terms to [email protected]. Together with the Privacy Policy (lingoshu.com/privacy) and the Legal Notice/Impressum (lingoshu.com/impressum), these Terms form the agreement between you and us on the use of the service. Effective: 28 June 2026.
