본 문서는 한국 이용자의 편의를 위해 제공되는 정보성 한국어 번역본입니다. 법적으로 구속력을 가지며 정식 기준이 되는 것은 독일어 원문 이용약관(Nutzungsbedingungen)이며, https://lingoshu.com/terms에서 확인하실 수 있습니다. 이러한 언어 선택은 이용자께서 거주국의 법에 따라 보장받는 강행적 소비자 보호를 박탈하지 않습니다(제14항, 로마 I 규정 제6조 제2항 참조).

본 문서는 「LingoShu Translator」 앱 및 lingoshu.com 웹사이트에 적용됩니다.

1. 적용 범위, 제공자 및 계약 상대방 / Scope, Provider, Contracting Party

본 이용약관(이하 "이용약관")은 iOS 앱 「LingoShu Translator」(이하 "앱")와 웹사이트 lingoshu.com(이하 앱과 합하여 "서비스")의 이용에 적용됩니다. 본 이용약관은 이용자(이하 "이용자")와 제공자 사이의 관계를 규율하며, 동시에 앱에 대한 최종 사용자 라이선스 조건을 포함합니다(제4항 및 제15항).

서비스 이용에 관한 제공자이자 계약 상대방은 다음과 같습니다.

당사는 독일 민법(BGB) 제13조의 의미에서의 소비자만을 대상으로 서비스를 제공합니다. 본 이용약관은 오로지 이용자와 당사 사이에서만 체결되며, Apple과는 체결되지 않습니다. Apple은 이용자께서 앱을 다운로드하신 App Store를 제공할 뿐입니다. Apple의 역할에 관한 자세한 내용은 제6항, 제7항 및 제15항에서 확인하실 수 있습니다. 현재 앱은 오로지 Apple App Store를 통해서만 배포됩니다.

본 이용약관과 개인정보 처리방침(lingoshu.com/privacy/ko) 및 사업자 정보(Impressum, lingoshu.com/impressum)는 함께 서비스 이용에 관한 법적 근거를 이룹니다. 개인정보 처리방침은 당사가 어떤 데이터를 처리하는지를 설명하며, 개인정보 처리에 관한 사항에서 본 이용약관과 상충되는 경우 개인정보 처리방침이 우선합니다. 이용자께서는 언제든지 lingoshu.com/terms/ko에서 본 이용약관을 열람·저장·출력하실 수 있습니다. 계정을 생성하시거나 서비스를 이용하심으로써 이용자께서는 본 이용약관에 동의하시게 됩니다.

These Terms govern your use of the LingoShu Translator app and the lingoshu.com website and also contain the end-user licence terms for the app (Sections 4 and 15). The provider and your contracting party for use of the service is VinLihs Digital Services, owner Vincent Leinhos, Mainzer Landstr. 148, 60327 Frankfurt am Main, Germany ([email protected]). The service is offered to consumers only. These Terms are concluded between you and us, not with Apple — Apple only operates the App Store through which you obtained the app (the app is currently distributed exclusively via the Apple App Store). Together with our Privacy Policy and Legal Notice (Impressum), these Terms form the legal basis of your use; for data-processing questions the Privacy Policy prevails. You can view, save and print these Terms at lingoshu.com/terms. By creating an account or using the service you accept these Terms.

2. 계약의 목적 및 서비스 설명 / Subject Matter and Description of Service

LingoShu Translator는 두 사람 간의 대면 대화를 위한 AI 기반 음성 번역 앱입니다. 두 대화 상대가 각자의 언어를 선택하고, 녹음한 뒤 말하면, 앱이 말한 내용을 전사(음성 인식)하고 번역합니다. 서비스는 다양한 언어를 지원하며, 그때그때의 최신 언어 목록은 앱에서 확인하실 수 있습니다.

앱은 두 가지 작동 모드를 제공합니다.

품질에 관한 중요한 안내: 번역과 전사는 인공지능을 이용하여 기계적으로 생성됩니다. 모든 자동 번역과 마찬가지로, 부정확함, 오류 또는 문맥에 맞지 않는 표현을 포함할 수 있습니다. 본 서비스는 일상적인 대면 대화를 보조하기 위한 것입니다. 본 서비스는 오류가 손해를 초래할 수 있는 의료·법률·행정·금융 또는 그 밖의 안전상 중대한 상황 및 긴급 상황에서 신뢰할 수 있는 번역으로 사용되도록 의도되지 않았으며, 그러한 용도에 적합하지도 않습니다. 그러한 경우에는 자격을 갖춘 전문가나 사람 번역사의 도움을 받으시기 바랍니다. 이러한 인공지능 기반의 기계적 번역 생성은 서비스의 합의된 성상(品質)입니다(제9항 참조). 이용자의 법정 하자담보책임상의 권리는 영향을 받지 않습니다.

서비스는 특정 국가에서만 제공됩니다. 허용되지 않은 지역에서의 요청은 거부됩니다(지역별 이용 가능성, 제8항 및 개인정보 처리방침 참조).

LingoShu provides AI-assisted speech translation for one-to-one conversations in a range of languages (see the current list in the App), in two modes: an Online mode (audio is sent via our backend to OpenAI's APIs for speech recognition and translation; it needs connectivity and third-party availability, and audio/transcripts are processed in memory only, not stored on our servers) and an Offline mode (fully on-device via Apple's frameworks; nothing leaves your device, subject to device support for the language pair). Translations are machine-generated by AI and may be inaccurate or incomplete. The service is for everyday conversation and must not be relied upon in medical, legal, official, financial or safety-critical situations or emergencies where errors could cause harm — use a qualified professional there. This AI-based generation is an agreed quality of the service (see Section 9); your statutory warranty rights remain unaffected. The service is offered in selected countries only.

3. 계약의 성립, 계정 및 이용 자격 / Contract Formation, Account, Eligibility

서비스를 이용하시려면 "Apple로 로그인(Sign in with Apple)"으로 로그인하셔야 합니다. 이때 당사는 Apple로부터 불투명한 이용자 식별자만을 받으며, 이용자의 이름이나 이메일 주소는 받지 않습니다(자세한 내용은 개인정보 처리방침 참조). 최초로 로그인하여 계정을 생성하시는 시점에 이용자와 당사 사이에 서비스 이용에 관한 계약이 성립합니다.

서비스의 이용은 만 13세 이상인 자에게 허용됩니다. 이용자의 거주국 법이 서비스 이용 또는 유효한 동의에 관하여 더 높은 최저 연령을 정하고 있는 경우에는 그 연령이 적용됩니다. 만 13세에서 18세 사이의 미성년자는 유료 기능(특히 Pro 구독 및 크레딧 패키지)을 법정대리인의 동의가 있는 경우 또는 자유로운 처분이 허락된 재산의 범위 내에서만(독일 민법 제110조) 구매할 수 있습니다. 유료 구매를 하심으로써 이용자께서는 이러한 요건이 충족됨을 확인하시는 것입니다.

이용자 1인당 하나의 계정이 예정되어 있습니다. 이용자께서는 본인의 Apple 계정 및 그에 따른 LingoShu 계정에 대한 접근을 적절히 보호할 책임이 있습니다.

You sign in with Apple; we receive only an opaque identifier, not your name or email. The use contract is formed when you first create an account. The minimum age to use the service is 13; where the law of your country of residence sets a higher minimum age, that higher age applies. Minors aged 13–18 may buy paid features (Pro subscription, credit packs) only with the consent of a legal guardian or within means left to their free disposal (Sect. 110 BGB); by making a paid purchase you confirm this. One account per user; you are responsible for protecting access to your Apple account.

4. 이용권(라이선스) / Licence

당사는 이용자께 앱을 개인적·비상업적 대화 번역 목적으로 이용할 수 있는, 단순한(비독점적), 양도 불가능하며 계약 기간으로 제한된 권리를 부여합니다. 본 라이선스는 이용자께서 소유하거나 통제하는 모든 Apple 기기에서의 이용에 적용되며, 오로지 Apple Media Services 약관의 사용 규칙(Usage Rules)에 따라서만 적용됩니다. 이용자께서 소유하거나 통제하지 않는 기기에서의 이용, 그리고 여러 기기의 동시 이용을 위한 네트워크를 통한 배포는 허용되지 않습니다. 다만 사용 규칙(특히 가족 공유)이 허용하는 범위 내에서의 공동 이용은 허용됩니다.

본 라이선스의 종료는 제11항(특히 중대한 위반의 경우) 및 법령의 규정에 따릅니다. 당사는 라이선스를 임의로 철회할 수 있는 자유로운 권리를 유보하지 않습니다.

모든 저작권, 상표권 및 그 밖의 보호권을 포함한 앱에 관한 일체의 권리는 당사 또는 당사의 라이선서에게 귀속됩니다. 오프라인 모드에서 사용되는 언어 및 번역 모델은 Apple에 귀속되며 Apple의 약관의 적용을 받습니다. 본 이용약관에서 명시적으로 부여된 권리를 넘어서는 어떠한 앱에 대한 권리도 이용자께 이전되지 않습니다.

We grant you a limited, non-exclusive, non-transferable licence, limited to the term of the contract, to use the app for personal, non-commercial conversation translation on any Apple device you own or control, consistent with the Usage Rules of Apple's Media Services Terms (no use on devices you do not own/control; no network distribution for simultaneous multi-device use; shared use is permitted as the Usage Rules permit, including Apple Family Sharing). Any termination of this licence follows Section 11 (in particular for serious breach) and statutory law; we do not reserve a free right to revoke the licence at will. All intellectual property in the app remains with us or our licensors; the offline language models belong to Apple and are subject to Apple's terms. No rights beyond those expressly granted are transferred.

5. 이용자의 의무 및 준수 사항 / User Obligations and Acceptable Use

이용자께서는 적용되는 법령과 본 이용약관에 따라서만 서비스를 이용하실 수 있습니다. 이용자께서는 번역을 의뢰하신 콘텐츠 및 그 번역 결과를 사용하는 방식에 대하여 단독으로 책임을 지십니다.

특히 다음의 행위는 허용되지 않습니다.

이러한 의무를 위반하는 경우 제11항에 따른 조치가 취해질 수 있습니다.

Use the service only lawfully and in line with these Terms; you are responsible for the content you translate and how you use the results. Prohibited: abusive, automated or commercial bulk use that is not personal conversation translation; scraping or excessive load; circumventing or manipulating the credit/billing system or fair-use safeguards; reverse engineering, decompiling or disassembling the app except where mandatory law (in particular Sects. 69d and 69e UrhG) allows; and using the service for unlawful, infringing or harmful content. Breaches may lead to measures under Section 11.

6. 가격, 구독 및 인앱 구매 / Pricing, Subscription and In-App Purchases

서비스는 무료 한도의 범위 내에서 이용하실 수 있습니다. 새 계정에는 온라인 이용을 위한 제한된 무료 환영 크레딧이 제공됩니다. 크레딧이 모두 소진되면 온라인 이용은 차단됩니다. 오프라인 모드는 언제나 무료로 이용하실 수 있습니다.

유료 서비스는 다음과 같습니다.

모든 유료 서비스는 오로지 Apple 인앱 구매를 통해서만 구매·결제됩니다. 이와 관련하여 결제, 청구, 자동 갱신 및 환불에 관한 계약 상대방은 그때그때 적용되는 Apple 약관에 따라 Apple(Apple Distribution International Ltd., 아일랜드)입니다(제7항도 참조). Pro 구독은, 현재 기간이 종료되기 최소 24시간 전까지 해지하지 않는 한, 그때그때 선택된 기간에 대하여 해당 기간에 대해 표시된 가격으로 자동 갱신됩니다. 갱신 대금은 현재 기간이 끝나기 24시간 이내에 청구됩니다. 구독의 관리 또는 해지는 언제든지 오로지 이용자의 Apple 기기 설정에서 이용자 이름 → 구독에서만 하실 수 있으며, 당사를 통한 관리나 해지는 기술적으로 불가능합니다. 가격 변경은 Apple의 규칙에 따르며, 동의가 필요한 가격 변경에 대해서는 Apple이 이용자께 안내합니다. 이용자께서 Apple에 인앱 구매에 대한 환불을 신청하시는 경우, Apple은 해당 구매에 관한 이용 데이터를 당사에 요청할 수 있습니다. 이 경우 Apple이 이용자의 환불 신청을 결정할 수 있도록, 당사가 구매한 서비스가 이미 어느 정도 이용되었는지를 Apple에 전송하는 것에 이용자께서 동의하시는 것입니다(자세한 내용은 당사의 개인정보 처리방침 참조).

당사는 독일 부가가치세법(UStG) 제19조 제1항의 의미에서의 소규모 사업자(Kleinunternehmer)로서 부가가치세를 부과하지 않습니다. Apple이 구매의 계약 상대방이자 청구 주체이므로, 이용자께는 Apple이 표시하는 최종 가격이 적용됩니다.

공정 이용. LingoShu Pro는 대화 상황에서의 통상적인 개인적 이용을 위한 것입니다. 모든 이용자에 대하여 지속적으로 안정적이고 공정한 운영을 보장하고 남용을 방지하기 위해, 당사는 명백히 정상적인 개인적 이용에 의해 포섭되지 않는 이용 — 예컨대 자동화된, 상업적·대량의, 또는 그 밖의 남용적 이용 — 에 대하여, 온라인 이용을 일시적으로 제한(throttle)하거나 오프라인 모드로 안내하는 방식으로 적정한 범위 내에서 대응할 권리를 유보합니다. 그러한 조치는 서비스의 유지 및 남용 방지를 위해 필요하고 이용자께 수인 가능한 범위에서만, 그리고 — 상황상 가능한 한 — 사전 고지와 함께 이루어집니다. 정상적인 개인적 이용은 이에 영향을 받지 않으며, 무료 오프라인 모드는 어떠한 경우에도 계속 이용하실 수 있습니다.

New accounts get limited free welcome credits for online use; when the balance runs out, online use is blocked, while offline mode is always free. Paid options are LingoShu Pro (4.99 EUR/month or 39.99 EUR/year, auto-renewing) and consumable credit packs (one-time purchases, consumed per online use, no cash value, non-transferable). All paid items are bought and billed via Apple In-App Purchase; Apple (Apple Distribution International Ltd., Ireland) handles payment, billing, renewal and refunds. The subscription auto-renews for the chosen period at the displayed price for that period unless cancelled at least 24h before the period ends, and the renewal is charged within 24h before the period ends; you manage or cancel only in your Apple device settings under your name → Subscriptions, not through us. As a small business under Sect. 19 UStG we charge no VAT; Apple's displayed prices apply. If you request a refund from Apple for an in-app purchase, Apple may ask us for consumption information; you agree that we then tell Apple how much of the purchase you have already used so Apple can decide on your refund (details in our Privacy Policy). Fair use: Pro is for ordinary personal conversation use; to keep the service stable for everyone and prevent abuse, we may take proportionate measures (temporarily throttling online use or referring you to offline mode) against use that clearly goes beyond normal personal use, such as automated, commercial bulk or otherwise abusive use, only where necessary and reasonable for you and, where feasible, with notice. Ordinary personal use is not affected; the free offline mode always remains available.

7. 청약철회권 / Right of Withdrawal

이용자께서는 소비자로서 법정 청약철회권을 가집니다. 디지털 서비스에 관한 통신판매계약의 경우, 이용자께서는 원칙적으로 구매일로부터 14일 이내에 사유를 밝히지 않고 구매를 철회하실 권리가 있습니다. Apple Distribution International Ltd.가 이용자의 인앱 구매의 판매자이자 청구 주체이므로(제6항 참조), 청약철회는 실제로는 Apple을 통하여 Apple의 약관에 따라 처리됩니다. 문의 사항이 있으시면 [email protected]으로 당사에 연락하실 수 있습니다.

디지털 서비스의 경우, 청약철회권은 법정 요건(독일 민법 제356조 제5항)에 따라 조기에 소멸할 수 있습니다. 이러한 요건 — 즉 청약철회 기간이 종료되기 전에 이행을 개시하는 것에 대한 이용자의 명시적 동의, 서비스의 완전한 이행으로써 청약철회권을 상실하게 된다는 점에 대한 이용자의 명시적으로 확인된 인지, 그리고 그러한 동의의 지속적 저장매체(durable medium)를 통한 전달 — 이 Apple의 구매 절차에서 충족되는 범위에서, 청약철회권은 서비스의 완전한 이행 시점에 소멸합니다. 이러한 동의는 구매 절차에서 Apple에 의해 수령·전달됩니다.

청약철회 또는 환불 신청은 Apple에 하시는 것이 가장 간편합니다 — reportaproblem.apple.com의 "문제 신고(Report a Problem)" 기능을 이용하시거나, Apple Distribution International Ltd., iTunes Store Customer Support, Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, [email protected]으로 의사표시를 하시면 됩니다. 그때그때 적용되는 Apple Media Services 약관이 기준이 되며, 이는 apple.com/legal/internet-services/itunes에서 확인하실 수 있습니다. 기존 구독의 관리 또는 해지는 이용자의 Apple 기기 설정에서 이용자 이름 → 구독에서 하실 수 있습니다.

아울러 lingoshu.com/withdrawal에서 이용자를 Apple의 청약철회 및 환불 기능으로 안내하는 안내를 확인하실 수 있습니다. 다만 Apple을 통해 체결된 매매계약에 대하여는 Apple을 통한 처리가 기준이 됩니다.

You have a statutory right of withdrawal. For distance contracts over digital services you generally have the right to withdraw from a purchase within 14 days without giving reasons. Because Apple Distribution International Ltd. is the seller and billing agent of your in-app purchases (see Section 6), withdrawal is processed practically through Apple and under Apple's terms; if you have any questions, you can reach us at [email protected]. For digital services the right can lapse early under Sect. 356 (5) BGB: where the conditions are met in the Apple checkout — your express consent to performance beginning before the withdrawal period ends, your acknowledged awareness that the right lapses on complete performance, and transmission of that consent on a durable medium — the right lapses upon complete performance of the service; Apple obtains and transmits this consent during checkout. To withdraw or request a refund, use Apple's “Report a Problem” (reportaproblem.apple.com) or contact Apple Distribution International Ltd., Cork, Ireland ([email protected]). Manage or cancel a subscription via your Apple device settings under your name → Subscriptions.

8. 서비스의 가용성, 유지보수 및 변경 / Availability, Maintenance and Service Changes

당사는 서비스를 가능한 한 안정적으로 제공하기 위해 노력하지만, 중단 없는 가용성을 보장할 의무는 부담하지 않습니다. 가용성은 유지보수 작업, 기술적 장애, 당사의 영향권 밖의 사건, 그리고 제3자 서비스(특히 OpenAI, Apple 및 Cloudflare)에 대한 의존성과 App Store를 통한 배포로 인해 제한될 수 있습니다. 필요한 유지보수 작업은 가능한 한 이용량이 적은 시간대에 수행합니다.

당사는 서비스를 발전·개선하고 개별 기능을 변경하거나 중단할 수 있습니다. 여기에는 품질, 보안 및 가용성을 유지하거나 개선하기 위해, 온라인 모드에 사용되는 AI 기술, 모델 및 서비스 제공자(현재 OpenAI)를 발전·갱신하거나 동등한 제공자로 대체할 권리가 포함됩니다. 이용자께 불리한 중대한 변경 또는 핵심 기능의 중단에 대해서는, 앱 내에서 또는 이메일로 적절한 사전 고지와 함께 안내해 드립니다. 온라인 모드는 활성화된 인터넷 연결과 통합된 제3자 서비스의 가용성을 전제로 합니다. 또한 서비스는 특정 국가에서만 제공됩니다(지역별 이용 가능성).

We aim for reliable availability but do not guarantee uninterrupted service; availability may be limited by maintenance, technical faults, force majeure, dependence on third-party services (OpenAI, Apple, Cloudflare) and App Store distribution. We perform necessary maintenance at low-traffic times where possible. We may further develop, improve, change or discontinue features. This includes the right to evolve, update or replace the AI technologies, models and providers used for the online mode (currently OpenAI) with equivalent providers to maintain or improve quality, security and availability. We will give reasonable advance notice in-app or by email of material changes that disadvantage you or of the discontinuation of essential features. Online mode requires connectivity and third-party availability, and the service is offered in selected countries only.

9. 하자담보책임 및 업데이트 / Warranty and Updates

유료 디지털 상품에 대하여는 디지털 상품에 관한 계약의 법정 하자담보책임(독일 민법 제327조 이하)이 적용됩니다. 당사는 이용자께 앱 내지 유료 기능을 물건의 하자 및 권리의 하자가 없는 상태로 제공하며, 해당 기간 동안 계약 적합성을 유지하기 위해 필요한 보안 업데이트를 포함한 업데이트를 제공하고 이에 대해 안내합니다. 당사가 적절히 안내하였음에도 제공된 업데이트가 합리적인 기간 내에 설치되지 않은 경우, 당사는 오로지 그로 인하여 발생한 하자에 대하여는 책임을 지지 않습니다.

추완이행, 계약의 해제, 대금 감액, 그리고 손해배상 및 비용상환에 관한 이용자의 법정 권리는 영향을 받지 않으며, 소비자에 대하여 이러한 권리를 배제하지 않습니다.

하자는 [email protected]으로 형식에 구애받지 않고 알려 주실 수 있습니다. 당사는 아울러 제2항에서 설명한 성상을 다시 안내드립니다. 번역은 인공지능을 이용하여 기계적으로 생성되며 부정확함을 포함할 수 있습니다. 온라인 모드는 연결 및 제3자 서비스를 전제로 하고, 오프라인 모드는 기기에 따라 달라지며, Pro 구독은 적정하고 공정한 이용의 범위 내에서 제공됩니다. 통상적으로 기대되는 바와 다른 이러한 특성들에 대하여 당사는 계약 체결 전에 명시적이고 별도로 이용자께 안내드리며, 구매가 체결됨으로써 이러한 성상을 명시적으로 합의합니다.

The statutory consumer warranty for digital products (Sect. 327 ff. BGB) applies to paid digital products and is not excluded. We provide the app and paid features free of defects and supply the updates, including security updates, needed to maintain conformity during the relevant period, and inform you about them; if you fail to install provided updates within a reasonable time after proper notice, we are not liable for defects caused solely thereby. Your statutory rights (supplementary performance, termination, price reduction, damages and reimbursement of expenses) remain unaffected. Report defects informally to [email protected]. As described in Section 2, translations are AI-generated and may contain errors, online mode depends on connectivity and third parties, offline mode depends on your device, and Pro is provided within fair, reasonable use — we disclose these characteristics expressly before contract conclusion and agree them as the agreed quality on purchase.

10. 책임 / Liability

당사는, 당사 또는 당사의 법정대리인이나 이행보조자의 과실 또는 고의에 의한 의무 위반에 기인한 생명·신체 또는 건강의 침해로 인한 손해에 대하여, 그리고 당사 또는 당사의 법정대리인이나 이행보조자의 고의 또는 중과실에 기인한 손해에 대하여 무제한으로 책임을 집니다. 또한 당사가 보증을 인수한 범위, 그리고 독일 제조물책임법(Produkthaftungsgesetz)의 규정에 따른 경우에도 무제한으로 책임을 집니다.

본질적 계약 의무의 경과실에 의한 위반의 경우, 당사의 책임은 그 금액에 있어 계약 체결 시 예견 가능한, 계약에 전형적인 손해로 제한됩니다. 본질적 계약 의무(주된 의무, Kardinalpflicht)란 그 이행이 비로소 계약의 정상적인 이행을 가능하게 하고 이용자께서 그 준수를 통상적으로 신뢰할 수 있는 의무를 말합니다. 그 밖의 경우 경과실에 대한 당사의 책임은 배제됩니다.

위 규정들로 인해 이용자께 불리하게 증명책임이 변경되지는 않습니다. 디지털 상품에 관한 법정 하자담보책임상의 권리(독일 민법 제327조 이하, 제9항)는 영향을 받지 않습니다. 위 책임 규정의 범위 내에서, 당사는 특히 부정확하거나 불완전한 번역 또는 전사로 인한 결과에 대하여는 책임을 지지 않습니다. 이와 관련하여 제2항의 이용 안내를 유의하시기 바랍니다. 소비자인 이용자께 배제할 수 없는 하자담보 또는 보증을 규정하는 다른 국가의 강행 법규(예컨대 호주 소비자법(Australian Consumer Law)에 따른 소비자 보증)가 적용되는 경우, 그러한 권리는 영향을 받지 않습니다. 위 책임 제한은 적용되는 강행 법규가 허용하는 범위에서만 적용되며, 그러한 배제할 수 없는 보증의 위반에 대한 당사의 책임은 — 법이 허용하는 범위에서 — 당사의 선택에 따라 서비스의 재이행 또는 재이행 비용의 상환으로 제한됩니다.

We are liable without limit for injury to life, body or health caused by any negligent or intentional breach by us, our legal representatives or agents, and for damage caused by our (or their) intent or gross negligence; likewise without limit where we gave a guarantee and under the Product Liability Act. For slightly negligent breach of an essential contractual duty (Kardinalpflicht — a duty whose fulfilment makes proper performance possible and on which you may regularly rely), liability is limited to the foreseeable, contract-typical damage. Otherwise liability for slight negligence is excluded. The above does not shift the burden of proof to your disadvantage, and your statutory digital-product warranty rights (Section 9) remain unaffected. Within these limits we are in particular not liable for the consequences of inaccurate or incomplete translations or transcriptions; see the usage guidance in Section 2. Where the mandatory law of another state applies to you as a consumer and provides non-excludable guarantees or rights (such as the consumer guarantees under the Australian Consumer Law), those remain unaffected; the above limitations apply only to the extent the applicable mandatory law permits, and our liability for breach of such a non-excludable guarantee is limited, where the law allows, at our option to re-supplying the service or paying the cost of re-supply.

11. 계약 기간 및 해지 / Term and Termination

서비스 이용에 관한 계약은 이용자의 계정이 존속하는 한 기간의 정함이 없이 유효합니다. Pro 구독의 기간 및 자동 갱신은 Apple을 통한 이용자의 구매에 따릅니다(제6항). 이용자께서는 언제든지 Apple 기기 설정에서 이용자 이름 → 구독에서 구독을 해지하실 수 있으며, 해지는 현재 결제된 기간의 종료 시점에 효력이 발생합니다.

이용자께서는 언제든지 앱에서 계정을 삭제하실 수 있습니다(설정 → "Delete Account"). 삭제와 함께 앱 이용에 관한 계약이 종료됩니다. 삭제 후 어떤 데이터가 남는지(특히 남용 방지를 위한 불가역적 해시)는 개인정보 처리방침에 설명되어 있습니다. 진행 중인 Apple 구독 연결이 있는 경우, 이용자의 Apple 기기 설정에서 이용자 이름 → 구독에서 별도로 해지하시기 바랍니다.

당사는 본 이용약관에 대한 중대한 위반, 남용적 이용 또는 위법한 행위가 있는 경우 서비스에 대한 접근을 전부 또는 일부 차단·제한하거나 종료할 수 있습니다. 그러한 조치는 비례적으로, 그리고 — 상황상 가능하고 수인 가능한 한 — 사전 고지와 함께 이루어집니다. 차단에 대해서는 가능한 한 앱 내에서 이용자께 안내드립니다. 이용자께서 차단에 동의하지 않으시는 경우, [email protected]으로 당사에 연락하여 이에 이의를 제기하고 재검토를 요청하실 수 있습니다 — 이미 앱을 삭제하신 경우에도 마찬가지입니다. 당사는 이용자의 이의를 검토하여 그 결과를 알려 드립니다. 중대한 사유로 인한 특별 해지권 및 그 밖의 법정 해지권은 양 당사자 모두에게 영향을 받지 않고 유지됩니다.

The use contract runs indefinitely while your account exists. The Pro subscription's term and renewal run via Apple (Section 6); you can cancel anytime in your Apple device settings under your name → Subscriptions, effective at the end of the current paid period. You can delete your account anytime in the app (Settings → “Delete Account”), which ends the use contract; the Privacy Policy describes what remains after deletion (notably an irreversible abuse-prevention hash). Cancel any active Apple subscription separately in your Apple device settings under your name → Subscriptions. We may suspend, restrict or terminate access for serious breach, abuse or unlawful conduct, proportionately and, where feasible, with prior notice. We notify you of a suspension in the app where possible; if you disagree, you may object and request a review by emailing [email protected] — also if you have already uninstalled the app — and we will review it and inform you of the outcome. Statutory and good-cause termination rights remain unaffected for both sides.

12. 소비자 분쟁 해결 / Consumer Dispute Resolution

당사는 소비자 분쟁조정기관(Verbraucherschlichtungsstelle)에서의 분쟁 해결 절차에 참여할 의사가 없으며 그러할 의무도 없습니다.

We are not willing or obliged to participate in dispute settlement procedures before a consumer arbitration board.

13. 본 이용약관의 변경 / Changes to these Terms

본 이용약관의 변경은 그 효력 발생 최소 6주 전에 문서 형식(예: 이메일 또는 앱 내 통지)으로 이용자께 제안됩니다. 당사는, 변경이 변경된 법령상 또는 최고법원의 요구 사항에 본 이용약관을 적합하게 하거나, 기술적 또는 보안상의 조정을 시행하거나, 이용자께 불리하지 않거나 비본질적인 앱의 새로운 기능을 반영하기 위해 필요하게 되는 범위에서만, 그리고 그 변경이 급부와 반대급부의 관계를 이용자께 불리하게 변경하지 않고, 부담하는 급부의 범위를 이용자께 불리하게 축소하지 않으며, 이용자를 부당하게 불리하게 하지 않는 범위에서만 이용자께 그러한 변경을 제안합니다.

이용자께서 변경의 제안된 효력 발생 시점 전에 당사에 거부 의사를 표시하지 않으시는 경우, 이용자의 동의가 있은 것으로 봅니다. 당사는 변경 제안 시 이용자의 침묵에 부여되는 이러한 승인 효과 및 이용자의 이의제기권과 해지권에 대하여 별도로 안내드립니다. 이용자께서 변경에 이의를 제기하시는 경우, 변경의 효력 발생 시점까지 언제든지 무료로, 그리고 해지 기간을 두지 않고 계약을 해지하실 수 있습니다. 그 밖의 경우 변경은 효력을 발생합니다.

가격의 변경, 급부의 주된 목적의 변경, 그리고 부담하는 급부의 범위에 대한 이용자께 불리한 중대한 변경은 이러한 동의 의제 방식으로 이루어지지 않습니다. 이러한 변경에 대하여는 당사가 이용자의 명시적 동의를 받거나, App Store에서의 새로운 청약을 통해 이루어집니다.

We will offer you changes to these Terms in text form (e.g. email or in-app) at least six weeks before they take effect, and only where needed to adapt to changed legal or supreme-court requirements, to make technical or security adjustments, or to reflect new features that are not disadvantageous to you or are non-essential, and only where the change does not shift the price–performance balance to your disadvantage, does not reduce the owed scope of service to your disadvantage, and does not unreasonably disadvantage you. Your consent is deemed given if you do not object before the proposed effective date; we will specifically point out this effect of silence and your right to object and to terminate. If you object, you may terminate free of charge and without notice period until the change takes effect; otherwise the change takes effect. Price changes, changes to the main subject matter and material disadvantageous changes to the owed scope of service are not made by this deemed-consent mechanism — for those we obtain your express consent or they run via a new App Store offer.

14. 준거법 및 관할 / Governing Law and Jurisdiction

독일연방공화국의 법이 적용됩니다. 이용자께서 소비자로서 다른 국가에 일상적 거소를 두고 계신 경우, 그 국가의 법의 강행 규정 — 합의로써 배제할 수 없는 규정 — 에 의해 이용자께 부여되는 보호는 이러한 준거법 선택에 의해 영향을 받지 않습니다(로마 I 규정 제6조 제2항). 따라서 한국에 거주하시는 소비자께서는, 「약관의 규제에 관한 법률」, 「전자상거래 등에서의 소비자보호에 관한 법률」, 「콘텐츠산업 진흥법」 등 한국법의 강행적 소비자 보호 규정에 따라 보장받는 권리를 본 준거법 선택으로 인해 박탈당하지 않습니다.

당사는 소비자인 이용자께 불리하게 법정 규정과 다른 관할 합의를 하지 않습니다. 토지관할 및 국제재판관할에 관하여는 법정 규정이 적용됩니다.

German law applies. If, as a consumer, you have your habitual residence in another state, the protection of the mandatory provisions of that state's law from which no agreement may derogate remains unaffected by this choice of law (Art. 6 (2) Rome I). We do not impose any jurisdiction agreement to your disadvantage as a consumer; the statutory rules on local and international jurisdiction apply.

15. Apple 관련 특별 조항 / Apple-Specific Terms

다음 조항들은 그 밖의 항을 보완하며 Apple과의 관계에서 적용됩니다. 위의 항들과 상충되는 경우, 다음의 Apple 관련 최소 조건들이 Apple에 관한 한 우선합니다.

These Apple-specific minimum terms supplement the rest. These Terms are between you and us only, not Apple, and we alone are responsible for the app and its content; Apple merely provides the App Store. The licence (Section 4) is limited, non-transferable, non-exclusive and for use on Apple devices you own or control under Apple's Usage Rules, with shared use as the Usage Rules permit (including Apple Family Sharing). We are solely responsible for any maintenance and support; Apple has no such obligation. We, not Apple, bear the statutory warranty for the app; if the app fails to conform to a warranty you may notify Apple, and Apple will refund the purchase price you paid, if any (including for in-app purchases such as the Pro subscription or credit packs), with no other warranty obligation to the maximum extent permitted by law — all further claims are our responsibility, and your statutory rights under Sect. 327 ff. BGB against us (Section 9) remain unaffected. We, not Apple, address product-liability claims, claims that the app fails to meet legal/regulatory requirements, and consumer-protection/privacy claims, and we alone handle any third-party intellectual-property claims. You must comply with applicable third-party terms (e.g. your mobile data plan). As required by Apple, you confirm that you are not located in a U.S.-embargoed or “terrorist-supporting” country and are not on any U.S. prohibited/restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. 최종 조항 / Final Provisions

본 이용약관의 어느 조항이 무효이거나 무효가 되더라도, 나머지 조항의 효력은 영향을 받지 않습니다. 무효이거나 흠결이 있는 조항을 갈음하여 법령의 규정이 적용됩니다.

본 이용약관과 관련된 통지 및 의사표시는 [email protected]으로 보내 주시기 바랍니다. 본 이용약관은 개인정보 처리방침(lingoshu.com/privacy/ko) 및 사업자 정보(Impressum, lingoshu.com/impressum)와 함께 서비스 이용에 관한 이용자와 당사 사이의 합의를 이룹니다.

If any provision of these Terms is or becomes invalid, the remaining provisions stay valid; the statutory rules replace an invalid or missing provision.
